Terms and Conditions

1. RENTAL TERM

The term of this Car Rental Agreement shall commence upon the date and time of Vehicle pickup as specified above and shall terminate upon the return of the Vehicle to the Owner, provided that all the terms of this Agreement have been fully complied with by both Parties. In the event that the Renter wishes to extend the term of this Agreement, approval must first be obtained from the Owner.

Please be advised that in the event of an extension of the rental term, we ask to please notify us a minimum of 24 hour notice prior to the scheduled return date. 

2.   RENTAL FEES

The Renter shall remit rental fees to the Owner in accordance with the following payment schedule:

First payment is due at the time of pick up. Extension Payments shall be due by 5:00 PM EST of the return date. All payments after are due by 5pm of return date. Should the Renter fail to remit payment by 5:00 PM EST on the due date, a late fee of $25 shall be assessed. In the event payment is not received within 24 hours of the due date, Owner reserves the right to disable and/or repossess the Rental Vehicle through the services of a security company.

You permit us to reserve or set aside against your payment card at the time of rental a reasonable amount in addition to the estimated total charges. We may use the reserve to pay all Charges. We will authorize the release of any excess reserve or set aside upon the completion of your rental, and your payment card issuer’s rules will apply to your credit line or your account being credited for the excess and may not be immediately released by your card issuer. You will pay us at or before the conclusion of this rental or upon demand of all Charges, including without limitation: (a) time charge as shown on the Rental Record; (b) mileage charges, including charges for extra miles, based on the per-mile rate specified on the Rental Record; (c) mileage charge based on our experience if the odometer is altered; (d) optional product and service fees; (e) fuel and a refueling fee if you return the Vehicle with less fuel than when rented; (f) applicable taxes, surcharges, airport facility fees, and airport concession recovery fees; (f) expenses we incur locating and recovering the Vehicle if you fail to return it or if we repossess it under the terms of this Agreement; (g) costs including pre- and post-judgment attorney fees we incur collecting payment from you or otherwise enforcing or defending our rights under this Agreement; (h) a reasonable cleaning fee if the Vehicle is returned substantially less clean than when rented or with evidence of smoking in the Vehicle; (i) towing, storage charges, forfeitures, court costs, penalties, and all other costs we incur resulting from your use of the Vehicle; (j) a surcharge if you return the Vehicle to a location other than the location where you rented the Vehicle or if you do not return it on the date and time due, and you may be charged the standard rates for each day (or partial day) after the due-in date noted on this Agreement; (k) replacement cost of lost or damaged parts and supplies used in Features and (l) if applicable, a redemption fee if you present a reward certificate, coupon or voucher associated with a loyalty program. All Charges are subject to a final audit. If errors are found, you authorize us to correct the Charges with your payment card issuer.

3. MILEAGE

The mileage limit is stated above. If you go of the milage requirement you will be charged $0.64/mile

4. LOSS OF KEYS

If the renter loses the key provided by the rental company, they are responsible for a $350 replacement fee. If the renter locks the key inside the car, they will be charged $175 for the rental company to send a locksmith to unlock the vehicle.

5.  DRIVERS LICENSE

All drivers must be 21 and have a valid driver license. Drivers under 25 may have to pay $35 on time fee

Internal national driver

If the license is not written in English we require an international driving permit
Must show driver’s license, passport, and proof of return travel.I agree that only the drivers listed on the rental agreement will be the only drivers driving the vehicle

6. AUTHORIZED DRIVERS

An additional driver may only be added to the contract at a rental location and may be added or removed in the middle of the contract. When adding an additional driver in the middle of the contract both the renter and the additional driver must be present at the location. All drivers must be listed on rental agreement.

The system will calculate the charges based on the dates the additional driver was listed on the rental.

All additional drivers must:

• Meet age requirements
• Appear at the rental counter with the primary renter
• Present a valid driver’s license

An additional daily fee may apply for any additional drivers listed on the rental agreement.

7. RESPONSIBILITY FOR DAMAGE OR LOSS; REPORTING TO THE POLICE 

You are responsible for damage to, or loss or theft of the Vehicle, which includes the cost of repair, or the actual cash retail value of the Vehicle on the date of the loss if it is not repairable or if we elect not to repair it, plus loss of use, diminished value of the Vehicle caused by damage to it or repair of it, and our administrative expenses incurred processing the insurance claim, whether or not you are at fault. You must report all accidents or incidents of theft and vandalism to us, and the police, as soon as you discover them

8.  INSURANCE COVERAGE OPTIONS

Option 1.

I agree to provide my own full coverage insurance covering you, us , & the vehicle in case of an accident. You are responsible for all damage or loss you cause to others. (Note: you are required to make the rental company a interested party on the policy for verification purposes of coverage & any changes that could occur to policy)

Option 2.

I have decided to provide liability insurance & purchase RENTERS COLLISION PROTECTION available through this car rental company for $12 per day, including an admin fee $25 charged per reservation, per extension. I understand that this product will pay for any collision damage done to this rented vehicle up to a maximum $35,000 with a $0 deductible, as long as I or any ‘Authorized Drivers’ do not violate this contract. The purchase of the RCP is non-refundable, even if the rental vehicle is returned early.

Option 3.

I agree to allow the rental car company to create a personalized insurance policy, through a third party covering you, us, & the vehicle in case of an accident.

9. INSURANCE CLAIMS

In the event that the Rental Vehicle is damaged or destroyed while it is in the possession of Renter, Renter shall be responsible for paying the required insurance deductible in the amount of $1000, in the event that a claim is made for the damages. If a claim is not filed, Renter agrees to pay Owner directly for any repairs or damages incurred to the Rental Vehicle.

If a driver is in an accident In our rental vehicle, renters agree that Renter’s insurance or the insurance the renter purchased through a third party at the time of rent, is to pay the Repair company or Car Rental Naples Fl directly. Renter also agrees that your insurance/your third party protection works with Car Rental Naples directly and keeps our team informed throughout the whole process. Renter agrees that all insurance payments for damages to our rental vehicle rented by {{contact.name}} is to be paid directly to the repair shop or Car Rental Naples FL.

10.  INDEMNIFICATION 

The Renter hereby agrees to indemnify, defend, and hold harmless the Car Rental Naples FL, its owner, employees, and affiliates from any and all claims, demands, causes of action, losses, damages, and expenses, including reasonable attorney’s fees, arising out of or in connection with the Renter’s use or operation of the Rental Vehicle during the rental period. The Renter shall assume full responsibility and pay for any parking tickets, moving violations, tolls, or other citations received while in possession of the Rental Vehicle, and shall promptly notify the Owner of any such citations. The indemnification also includes any attorney fees necessarily incurred by the Owner for these purposes. Furthermore, the Rental Company shall not be liable for any loss, damage, or injury to the Renter or any third party arising from the use of the Rental Vehicle, whether caused by the Renter’s negligence or otherwise. 

11.  CHECK-IN & CHECK OUT PROCESS

A comprehensive inspection of the vehicle’s condition is mandatory before & after rental period. Before the trip begins, a meticulous assessment of the vehicle’s state is conducted in the presence of the customer to document any pre-existing damages or issues. After the trip ends, another detailed inspection occurs with the customer to evaluate the vehicle’s condition post-trip. It’s crucial that the customer remains present during inspection to address any potential damages or discrepancies that may have occurred during their use of the vehicle. If there are any damages done, the renter is responsible for $1000 as an additional charge. This process ensures transparency and fairness regarding the vehicle’s condition and any associated costs.

12.  VEHICLE CONDITION AND MAINTENANCE 

 The owner represents and warrants that, to the best of the Owner’s knowledge, the Rental Vehicle is in good condition and is safe for ordinary operation. Prior to taking possession of the Rental Vehicle, Renter has the opportunity to inspect the vehicle for any existing damages to the vehicle. For long-term renters, Owner shall cover basic maintenance such as oil changes, wipers, air filters, and cabin filters. However, the Renter shall be responsible for any damages, such as blown tires or damaged wheels, windshield, glass and associated repairs. All maintenance and repairs shall be conducted by a mobile mechanic. For all long-term renters, a mandatory safety inspection shall be conducted every 30-45 days.

13. REFUELING

Option 1 – prepay for fuel

Return the car on the same level of fuel you receive the car with

14.  CAR RENTAL CHARGES AND FEES

Please ensure the vehicle is returned in the same condition as when it was rented to avoid these charges.

This fee Is Charged one time for if you need the vehicle Picked up. One time for if you need the vehicle dropped off.

You agree that we may disclose personally identifiable information about you to applicable law enforcement agencies or to other third parties in connection with our enforcement of our rights under this Agreement. Questions regarding privacy should be directed to the location where you rented the Vehicle. You agree, in order for us to service or otherwise administer our account or to recover any amounts you may owe, that we or any assignee or collection agency of our choosing, may contact you by telephone at any telephone number associated with your account, including wireless telephone numbers, which could result in additional charges to you. We, our assignee, or any collection agency of our choosing, may also contact you by sending text messages or emails, using any e-mail address you provide to use. Methods of contact may include using pre-recorded/artificial voice messages and/or use of an automatic dialing device, as applicable.

15.  OUT OF STATE DRIVING 

Out of state driving is strictly prohibited with the Rental Vehicle. In the event that Renter utilizes the Rental Vehicle outside of the state without such consent, the rental agreement will be terminated. In the event of any mechanical issue or damage to the Rental Vehicle while outside of the state, Renter shall be fully responsible for all associated expenses incurred by Owner, including but not limited to towing fees and repair costs.

16.  FREE WILL CLAUSE

Car Rental Naples FL affirms the free will of its customers to enter into rental agreements voluntarily. Customers acknowledge that they are entering into contracts of their own accord, without  coercion, and with a clear understanding of the terms and conditions outlined in the agreement. 

17. DISCRIMINATORY CLAUSE

Car Rental Naples FL strictly prohibits any form of discrimination against customers based on race, color, religion, sex, national origin, disability, or any other protected characteristic. The agency is committed to providing equal access and opportunities to all customers, ensuring a fair and inclusive rental experience for everyone. 

18.  ECPA “Electronically Funded Payment” CLAUSE

Car Rental Naples FL, in compliance with the Electronic Communications Privacy Act (ECPA), acknowledges that customer receipts of payment, whether in electronic or written form, shall be treated with the utmost confidentiality. The agency commits to safeguarding the privacy of payment information and will not disclose, sell, or share such information with third parties without the express consent of the customer, except as required by law. 

19. OPT-IN/ OPT OUT CLAUSE

Car Rental Naples FL, in compliance with the Electronic Communications Privacy Act (ECPA), acknowledges that customer receipts of payment, whether in electronic or written form, shall be treated with the utmost confidentiality. The agency commits to safeguarding the privacy of payment information and will not disclose, sell, or share such information with third parties without the express consent of the customer, except as required by law. 

20. ARBITRATION AGREEMENT

By entering into any contract with Car Rental Naples FL, the customer agrees that any disputes or claims arising out of or in connection with the contract shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The customer further agrees that, in the event of a breach of contract, Car Rental Naples FL retains the right to pursue legal action in small claims court or any appropriate venue to seek damages or injunctive relief as permitted by law.

21. BREACH OF CONTRACT

• Failure to Pay: Non-payment or late payment for rental services.
• Unauthorized Use: Using the rental vehicle for purposes not specified in the agreement.
• Failure to Return: Not returning the rental vehicle by the agreed-upon date and time.
• Negligence or Misuse: Neglecting or misusing the rental vehicle, causing damage
  beyond normal wear and tear.
• Unauthorized Drivers: Allowing an unauthorized person to drive the rental vehicle.
• Violation of Traffic Laws: Committing traffic violations or engaging in illegal activities with the rental vehicle.

• Subleasing or Unauthorized Transfers: Subleasing the rental vehicle to another party without proper authorization.
• Failure to Comply with Policies: Violating any specific policies outlined in the rental agreement, such as smoking or pet policies.
• Providing False Information: Providing false information during the rental process or on the rental

22. YOUR PROPERTY

 You release us, our agents and employees from all claims for loss of, or damage to, your personal property or that of any other person, that we received, handled or stored, or that was left or carried in or on the Vehicle or in any service vehicle or in our offices, whether or not the loss or damage was caused by our negligence or was otherwise our responsibility.

23.   RETURNING THE RENTAL CAR

Please give us a 24 hour notice of return. You will need to return the vehicle to the same exact location that you rented the vehicle from. If the vehicle was dropped off and you need the vehicle picked up, you must first talk to a Car Rental Naples representative before leaving the vehicle. You are responsible for all damages until the Rental car is checked in by a Car Rental Naples FL Employee.

ENTIRE AGREEMENT 

This Car Rental Agreement constitutes the entire agreement between the Parties with respect to this rental arrangement. No modification to this agreement can be made unless in writing signed by both Parties. Any notice required to be given to the other party will be made to the contact information above
